The National Football League legal battle continues as the 9th. U.S Circuit Court of Appeals has decided to officially reinstate the verdict surrounding the NFL Sunday Ticket case, The Hollywood Reporter states. The federal class-action lawsuit will now face a new trial against the NFL, according to the ruling issued today.
The lawsuit was originally based on how around 2.5 million residential and commercial subscribers had paid more for the subscription than they should have, in what should have been a fair market between 2011 and 2023. The NFL was suspected to have increase prices on purpose with little to no competition for the subscription by blocking cheaper options, leading the subscribers to be overcharged due to the purposeful inflation made by the NFL league.
The trial had first been thrown out in court back in 2024. This decision was made by a lower court judge based in California, and the NFL was fined with $4.7 billion in damages in the lawsuit, but now is being reversed. The panel had officially ruled that the judge made an error when throwing out this case, thus reinstating it for a new trial today.
The panel explicitly expressed that the judge had overstepped by throwing out the experts testimonies. The experts, being economic experts, had demonstrated models through data and methods to show what the NFL market should have looked like instead of the unfair prices were marked. These experts are now being brought back to this case after their testimonies being thrown out, and now the financial damages will be re-evaluated in the new trial.
It was also not just the NFL league that was listed in this legal battle, but all 32 NFL teams and the independently owned franchises were listed in the antitrust appeal as well.
The NFL is now once again liable for violating antitrust laws. As the revival of this case is still ongoing, the team at mxdwn will report with new developments as more unfolds.
