

It’s media versus President Trump in a prolonged lawsuit between Paramount Global and the president’s legal teams. According to Deadline, CBS has called Trump’s $20 billion lawsuit against 60 Minutes “meritless.” This all stems from a lawsuit Trump filed against the CBS news program, originally alleging their editing of an October interview with democratic presidential candidate Kamala Harris was biased in her favor.
According to Deadline, CBS also commented that Trump’s latest attempt seeks to “evade bedrock First Amendment principles.” Trump’s legal team has since revised its allegations, stating CBS allegedly violated the Texas Deceptive Trade Practices Act and the federal Lanham Act. Trump is claiming the edited interviews caused him harm because, if edited differently, he would have benefited from their traffic. His team ultimately claimed the interviews are commercial speech, as these laws typically handle claims of false advertising.
In the Deadline article, CBS notes that Trump’s legal team had provided, “this Court with nothing that would support the conclusion that the Face the Nation and 60 Minutes Broadcasts — involving an interview of a presidential candidate about issues of utmost public concern — are anything but fully protected editorial speech, and they cite not a single case holding that news broadcasts (or promotions for such broadcasts) are commercial speech. Indeed, the Supreme Court has repeatedly rejected that argument. The First Amendment applies fully to the news reporting at issue and bars Plaintiffs’ claims.”
CBS continued to state its case in the Texas court filing, stating, “President Trump has not plausible alleged that he personally suffered ‘an injury to a commercial interest in reputation or sales,” Deadline reports. The network’s legal team also argues that the President cannot stand on “intangible harms”.
At the same time, Deadline reports Paramount Global is hoping to get approval from the Trump Administration for the merger with Skydance Media. Many Democratic senators warned that a settlement between Paramount Global and the administration could violate federal bribery laws.
According to Deadline, CBS also had issues with Trump electing to file the false advertisement suit in Texas. They allege Trump’s team has failed to prove they “purposefully directed” any of its actions to the state, and seek to transfer the case back to New York state. Somewhat unrelated, the current judge presiding over the suit, Matthew J. Kacsmaryk, was appointed by Trump and has a history of leaning right.
